One of the most common divorce surprises in Alberta is learning that a signed separation agreement does not change the mortgage at all. Both names stay liable to the lender until the mortgage is refinanced, assumed with a release, or the home is sold — regardless of what the agreement says between the two of you. The spouse keeping the home must qualify for the mortgage alone, and that test should happen before the agreement is finalized, not after.

Qualifying on one income
The lender re-runs the full file on the keeper’s income: employment, support received or paid, other debts, and the stress test. Child or spousal support you receive can count as income with a track record and a formal agreement; support you pay reduces what you qualify for. If the solo file does not qualify yet, options include a co-signer, a longer timeline to build the support track record, or a planned sale — all better discovered early.
Title, legal steps and timing
Mortgage approval and the legal transfer of title move together through your lawyers, and land titles registration in Alberta takes time. Build that lag into possession and payout dates in your agreement. If a buyout amount depends on a valuation date, agree the valuation method at the same time, so the mortgage amount is not argued twice.
A note on rates
Posted rates are a starting point, not the final word. Rates are sometimes negotiable depending on the person and the situation, and we work with multiple lenders who offer different products and sometimes more competitive rates than any single posted table shows. Contact us and we will shop across lenders for your file — call Travis Bannert at (780) 720-8240. Any rate quoted for your file is based on an application and lender approval — it is confirmed only when a lender reviews your full application.
Start with a check, not a guess
Run your numbers through the Pre-Approval & Refinance Check — that page is the fastest way to sign up for a review of what you qualify for, what documents you need, and what your payment would look like on the homes you are actually watching in Edmonton and across Alberta.
Frequently asked questions
Does my ex stay responsible if I keep the house and the agreement says so?
To the lender, yes — until the lender releases them through a refinance or approved assumption. The agreement can allocate responsibility between you, but it does not bind the lender.
