Keeping an Inherited Home in Alberta: Mortgages, Probate and the Executor’s Options

General Travis Bannert 28 Oct

An inherited home arrives with grief attached and a mortgage file nobody in the family chose. In Alberta, the executor cannot usually deal freely with the property until probate is granted, the deceased’s mortgage does not simply disappear, and if several children inherit together, the one who wants to keep the house usually has to buy out the others — with financing arranged at exactly the moment paperwork is slowest. Starting the mortgage conversation early, in parallel with the legal work, is what keeps options open.

What happens to the existing mortgage

Most mortgages become due or must be addressed on death, but lenders generally work with estates that keep payments current while probate proceeds. Do not stop payments, and tell the lender what is happening in writing. If a beneficiary will keep the home, that person will normally need a new mortgage in their own name to pay out the estate or the other beneficiaries — their own income and credit decide that approval, not the deceased’s history.

Valuation, buyouts and family agreements

Get a proper valuation early; sibling buyouts built on a guessed price create the disputes that outlive the estate. Once probate and value are clear, the buyout mortgage is structured like any purchase between family members, with legal advice for each side. Document who paid what during the interim — taxes, insurance, repairs — so the final split reflects reality, not memory.

A note on rates

Posted rates are a starting point, not the final word. Rates are sometimes negotiable depending on the person and the situation, and we work with multiple lenders who offer different products and sometimes more competitive rates than any single posted table shows. Contact us and we will shop across lenders for your file — call Travis Bannert at (780) 720-8240. Any rate quoted for your file is based on an application and lender approval — it is confirmed only when a lender reviews your full application.

Start with a check, not a guess

Run your numbers through the Pre-Approval & Refinance Check — that page is the fastest way to sign up for a review of what you qualify for, what documents you need, and what your payment would look like on the homes you are actually watching in Edmonton and across Alberta.

Frequently asked questions

Can I get a mortgage on a home I inherited before probate is finished?
Usually the new mortgage funds after probate is granted and title can transfer. You can, however, get fully assessed and pre-approved during probate so funding is ready when the legal step completes.
